Pennsylvania House Republican leaders have expressed approval of a recent Pennsylvania Supreme Court decision regarding the counting of mail-in and absentee ballots. The court ruled in the case of Republican National Committee v. All 67 County Boards of Elections that counties should not count ballots failing to comply with the state's Election Code.

House Republican Leader Bryan Cutler and incoming Leader Jesse Topper issued a joint statement applauding the decision. They stated, "We applaud the decision of the Pennsylvania Supreme Court to order counties to not count mail-in and absentee ballots that fail to comply with the Pennsylvania Election Code."

The leaders emphasized that this ruling supports previous interpretations of the Election Code, particularly concerning the requirement for ballots to be correctly dated. They noted, "A law is not confusing or inconsistent merely because people do not like it. The Pennsylvania Election Code unambiguously states that mail-in and absentee ballots must be correctly dated to be valid."

Cutler and Topper further suggested that Sen. Bob Casey should concede the election to Sen.-elect Dave McCormick following this decision, arguing it would prevent unnecessary recounts and questions about election validity.
